Section 107-530; Ord. 19172; Rezoning property located on the west side of Santiago Drive, south of Granada Boulevard from District R-3 to District PUD-20.7; approving the Bethel Ridge PUD development plan

     AN ORDINANCE

rezoning property located on the west side of Santiago Drive, south of Granada Boulevard from District R-3 to District PUD-20.7; repealing all conflicting ordinances or parts of ordinances; approving the Bethel Ridge PUD development plan; allowing a reduction in the required perimeter setback; approving less stringent screening requirements; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A TRACT OF LAND LOCATED IN THE SOUTHWEST QUARTER OF SECTION 25, TOWNSHIP 48 NORTH, RANGE 13 WEST, BOONE COUNTY, MISSOURI, BEING PART OF LOT 3B OF THE REPLAT OF LOT 3, ROCKBRIDGE SUBDIVISION BLOCK 5 AND TRACT A OF THE SEVEN-TRACT SURVEY RECORDED IN BOOK 460, PAGE 495, RECORDED IN PLAT BOOK 39, PAGE 125 OF THE RECORDS OF BOONE COUNTY, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 3B, SAID CORNER BEING LOCATED ON THE WEST RIGHT-OF-WAY LINE OF SANTIAGO DRIVE, THENCE WITH THE EAST LINE OF SAID LOT 3B AND SAID RIGHT-OF-WAY LINE S2°57’ 00”E, 333.29 FEET; THENCE LEAVING SAID EAST LINE OF LOT 3B AND SAID RIGHT-OF-WAY LINE, S87°03’ 00”W, 380.77 FEET; THENCE N2°57’ 00”W, 333.29 FEET TO THE NORTH LINE OF SAID LOT 3B, THENCE WITH SAID NORTH LINE, N 87°03’ 00”E, 380.77 FEET TO THE POINT OF BEGINNING AND CONTAINING 2.91 ACRES.

will be rezoned and become a part of District PUD-20.7 (Planned Unit Development) with a development density not exceeding 20.7 dwelling units per acre and taken away from District R-3 (Medium Density Multiple-Family Dwelling District).  Hereafter the property may be used for a three-story apartment community designed exclusively for adults who are 62-years and older, a gazebo and potting shed.  The statement of intent submitted by applicant, marked AExhibit A@ is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The City Council hereby approves the Bethel Ridge PUD development plan dated August 3, 2006.

    SECTION 4.    The City Council approves less stringent yard requirements than those set forth in Section 29-10(d)(7) to allow a reduced perimeter setback of five-feet along the west property line.

    SECTION 5.    The City Council approves less stringent screening requirements than those set forth in Section 29-25(e)(5) of the Zoning Regulations so that a landscape screen shall not be required along the west and south property lines adjacent to the R-3 zoned tract.

    SECTION 6.    This ordinance shall be in full force and effect from and after its passage.
