     AN ORDINANCE

rezoning property located between Paris Road (State Route B) and Alpine Drive, south of U.S. Highway 63 from District M-C to District C-P; repealing all conflicting ordinances or parts of ordinances; setting forth conditions of approval; approving a revised list of C-P uses; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

FIVE TRACTS OF LAND LOCATED IN THE SOUTHEAST QUARTER OF SECTION 32, TOWNSHIP 49 NORTH, RANGE 12 WEST, CITY OF COLUMBIA, BOONE COUNTY, MISSOURI, BEING DESCRIBED AS:

TRACT 1:    
LOT 1 OF NORTHPOINT SUBDIVISION AS RECORDED IN PLAT BOOK 34, PAGE 57, OF THE BOONE COUNTY RECORDS, AND CONTAINING 3.47 ACRES.

TRACT 2:
LOTS 8, 9, 10, 11, AND THE VACATED PORTION OF ALPINE DRIVE AS SHOWN BY THE SURVEY RECORDED IN BOOK 2920, PAGE 89, OF THE BOONE COUNTY RECORDS, AND CONTAINING 5.86 ACRES.

TRACT 3:
LOT 7 OF ALPINE ESTATES AS RECORDED IN PLAT BOOK 10, PAGE 51, OF THE BOONE COUNTY RECORDS, AND CONTAINING 16,700 SQUARE FEET.

TRACT 4:
A PORTION OF ALPINE DRIVE AS SHOWN BY ALPINE ESTATES, RECORDED IN PLAT BOOK 10, PAGE 51, OF THE BOONE COUNTY RECORDS AND BEING FURTHER DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHERNMOST CORNER OF LOT 7 OF ALPINE ESTATES AS RECORDED IN BOOK 10, PAGE 51, OF THE BOONE COUNTY RECORDS; THENCE S 88º51’ 35” W, 24.42 FEET; TO THE CENTERLINE OF ALPINE DRIVE; THENCE WITH SAID CENTERLINE S 01º08’ 25” E, 12.83 FEET; THENCE DEPARTING SAID CENTERLINE S 88º51’ 35” W, 24.42 FEET; THENCE N 30º17’ 15” E, 50.42 FEET TO THE SOUTHWEST CORNER OF SAID LOT 7; WITH THE SOUTH LINE OF SAID LOT 7 FOR THE FOLLOWING TWO (2) CALLS; THENCE S 66º40’ 15” E, 24.78 FEET; THENCE S 01º 08’ 25” E, 19.93 FEET TO THE POINT OF BEGINNING AND CONTAINING 1,105 SQUARE FEET.

PARCEL 3 OF THE WARRANTY DEED RECORDED IN BOOK 1293, PAGE 307, OF THE BOONE COUNTY RECORDS, AND CONTAINING 14,730 SQUARE FEET.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District M-C (Controlled Industrial District).  Hereafter the property may be used for the following uses:

Specific exclusions:

Pawn shops are prohibited from the entire site.
    There shall be no business on the northern one-half of the site that will operate 24-hours per day.

The statement of intent, marked AExhibit A,@ is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    The rezoning of the property described in Section 1 shall be subject to the following conditions:

    1.    The eastern tree preservation areas indicated on the April 2006 “Conceptual” Plan, marked AExhibit B,@ attached to and made a part of this ordinance, shall be included on any C-P plan submittal to provide a buffer between the proposed C-P development and residential property to the east.

    2.    A traffic impact study shall be done for the entire C-P zoned site at the time the first C-P development plan is submitted.  The developer shall pay the cost of all off-site improvements as indicated by the traffic impact study.

    SECTION 4.    The list of uses described in Section 1 shall replace the list of uses authorized by Ordinance No. 16513 passed on July 15, 2000 for an existing C-P zoned tract located north of the property described in Section 1.

    SECTION 5.    This ordinance shall be in full force and effect from and after its passage.
