     AN ORDINANCE

amending Chapter 27 of the City Code as it relates to electric rates; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    Chapter 27 of the Code of Ordinances of the City of Columbia, Missouri, is hereby amended as follows:

Sec. 27-112. Same--Residential service rate.

    (c)      Monthly rate charge. The monthly rate per kilowatt hour shall be as follows, subject to fuel adjustments as provided in section 27-118:

    (1)    Customer charge    $ 5.50 5.80 per month

    (2)    Energy charge

            All remaining kwh     8.587 9.958 cents per kwh

        Except when the customer has permanently installed in a living area a minimum of five (5) kilowatts of utility-approved electric space heating equipment which is the sole source of comfort heating (except decorative fireplaces) for the area(s) to be heated, the rate per kwh for the non-summer season will be:

            First 750 kwh     7.156 7.66 cents per kwh

            All remaining kwh     5.725 6.128 cents per kwh

    (d)      Minimum: The minimum monthly rate charge shall be five dollars and fifty eighty cents ($5.50 5.80).

Sec. 27-113. Same--Residential heat pump rate.

    (c)      Monthly rate charge: The monthly rate charge shall be as follows, subject to fuel adjustments as provided in section 27-118:

        Customer charge    $ 5.50 5.80 monthly

        All kwh above 750 kwh     5.009 5.362 cents per kwh

The monthly rate would apply to permanently installed heat pumps for the non-summer season.

    (d)      Minimum: The minimum monthly rate charge shall be five dollars and fifty eighty cents ($5.50 5.80).

    (c)      Monthly rate charge: The monthly rate per kilowatt hour shall be as follows, subject to fuel adjustments as provided in section 27-118:

    (1)    Customer charge:

        All remaining kwh     6.854 7.3397 cents per kwh

    (e)      High efficiency heat pumps: For customers having a permanently installed heat pump which is the primary source of comfort heating and which conforms to the special rules and regulations outlined in department rules entitled "Heat Pump Rules and Regulations," the monthly rate per kilowatt hour billed during the non-summer season for energy shall be as follows:

        First 1,500 kwh     7.215 7.726 cents per kwh

        All remaining kwh     6.133 6.5671 cents per kwh

    (f)      Minimum bill: The minimum bill for single-phase service, shall be five dollars and fifty eighty cents ($5.50 5.80) per month; for three-phase service, seven dollars and fifty eighty-two cents ($7.50 7.82) per month.

Sec. 27-121. Street and outdoor area lighting rate.

    (c)      Light and fixture rates: Light and fixture rates are as follows:

When required for outdoor area (dusk to dawn) lighting, a pole with one span of #6 aluminum wire, up to one hundred fifty (150) feet, and necessary pole line hardware and accessories, according to the following schedule:

    Wood pole    $ 2.77

    (f)      Outdoor area lighting. The outdoor area (dusk to dawn) lighting light and fixture rate shall be the same as the street lighting rate except all underground wire and conduit shall be installed and maintained by the customer. Whenever any customer desires special facilities not shown in the above rate schedules, such facilities shall be installed and maintained by the customer.

Sec. 27-121.1. Special outdoor lighting.

    (c)      Monthly rate charge. The monthly rate per kilowatt hour shall be as follows, subject to fuel adjustment as provided in section 27-118:

    (d)     Minimum monthly bill. The minimum bill for single- or three-phase service shall be forty-four dollars and eighty cents ($40.00 44.80) per month.

Sec. 27-121.2. Sixty-nine-kV service rate.

    (a)      Availability. The sixty-nine-kV service rate is available for consumers located within one thousand (1,000) feet of an existing sixty-nine-kV transmission line, whose requirements exceed five thousand (5,000) kilowatts of capacity, subject to the rules and regulations of the water and light department.  A sixty-nine-kV service rate is available, however, due to the complexity of this type service and the volatility of the electric market, each application will be considered on a case-by-case basis.  A contract will be negotiated by the water and light director with final approval by the city council.

     (b)     Type of service. The type of service shall be three-phase, sixty-hertz at sixty-nine-kV transmission voltage, where available.

    ( c)     Monthly rate charge. The monthly rate per kilowatt hour shall be as follows:

     Demand Charge:

     All kW of billing demand per kW    $8.39

     Energy:

     Cost per KWH    0.030

     (d)     Determination of billing demand. The billing demand will be determined from the highest thirty (30) minutes integrated kilowatt demand registered during the month by a suitable demand meter.

     (e)     Billing demand. The monthly demand charge shall be the maximum thirty (30) minute kW demand measured during the billing month, but not less than the maximum billing demand established during the billing months of June, July, August and September of the preceding eleven (11) month billing period.

     (f)    Service facility ownership. Each customer served under this rate shall provide at its sole risk, cost and expense, all facilities except metering equipment, including an approved transformer bank, circuit interrupters and other protective devices which will clear faults on the customer's side of delivery. Service will be supplied and metered at sixty-nine thousand (69,000) volts.

     (g)     Minimum monthly bill. The minimum bill for any month will be ninety (90) per cent of the highest billing demand established during the summer months of June, July, August and September.

     (h)     Payment in lieu of taxes and sales tax. In addition to the charge based on monthly rates as computed above, the total monthly charge for service shall include applicable sales taxes and in lieu of gross receipts tax payment equal to 7.5268 per cent of the monthly rate charge. Sales tax shall be applied to the total of the monthly rate charge and in lieu of gross receipts tax payment.

     (i)     Power factor. The customer will at all times maintain a power factor of not less than ninety (90) per cent lagging. If the power factor is less than ninety (90) per cent, the measured kW demand will be multiplied by the ratio of ninety (90) per cent divided by the actual power factor to determine the adjusted measured demand to be used for determination of billing demand.

     (j)     Fuel adjustment. In the event that a fuel adjustment cost is added to the city's retail rate structure in a manner to increase the cost of energy, that same fuel adjustment cost will be added to the cost of energy for bills rendered under this rate.

     (k)     Contract period. The contract period shall be not less than one year with one-year advance notice of termination.

    SECTION 2.    The new rates established in this ordinance shall be applied to utility bills beginning with the first complete cycle billed after October 1, 2006.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
