Section 107-613; Ord. 19234; Amending Ordinance No. 016915 and Ordinance No. 016916; approving the O-P Development Plan of Grove Park

     AN ORDINANCE

amending Ordinance No. 016915 and Ordinance No. 016916; approving the O-P Development Plan of Grove Park; setting forth conditions of approval; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Amended and Restated Exhibit A to Council Ordinance 16915, as Amended, set forth in “Attachment A” which is attached to and made a part of this ordinance, replaces Exhibit A which is attached to Ordinance No. 016915 passed on June 4, 2001.

    SECTION 2.    The Amended and Restated Exhibit A to Council Ordinance 16916, as Amended, set forth in “Attachment B,” which is attached to and made a part of this ordinance, replaces Exhibit A which is attached to Ordinance No. 016916 passed on June 4, 2001.

    SECTION 3.    The City Council hereby approves the OP Development Plan of Grove Park, dated September 8, 2006, located on the southeast corner of Nifong Boulevard and Bearfield Road.  The Director of Planning and Development shall use the design parameters set forth in AExhibit A@ which is attached to and made a part of this ordinance as guidance when considering any future revisions to the O-P Development Plan.

    SECTION 4.    Approval of the O-P Development Plan shall be subject to the following conditions:

1.    Prior to the issuance of any building permits, a payment of twenty-five dollars ($25.00) per lineal foot of frontage shall be made to the City toward future improvements to Nifong Boulevard.

2.    Before issuance of any building permit for construction on the subject property, property owner shall acquire a ten-acre conservation easement and shall enter into an agreement for voluntary annexation with the owner of the tract.  The conservation easement and annexation agreement shall be subject to the terms and conditions contained in the 4-page letter dated August 17, 2006 from attorney Craig Van Matre addressed to the director of planning and development, set forth in “Exhibit B” which is attached to and made a part of this ordinance.

    SECTION 5.    This ordinance shall be in full force and effect from and after its passage.
