Section 107-641; Defeated B331-06; Vacating street right-of-way on Mills Drive, between Hatton Drive and Tremont Court

     AN ORDINANCE

vacating street right-of-way on Mills Drive, between Hatton Drive and Tremont Court; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council finds and determines that the street right-of-way of Mills Drive, between Hatton Drive and Tremont Court, more particularly described as follows:

A portion of Tract 1 of a survey in Book 794, page 19, also being a portion of the east half of Section twenty-two (22), Township 48 North, Range 13 West, City of Columbia, Boone County, Missouri, and is more particularly described as follows:

Commencing at the east quarter corner of section 22, thence westerly along the mid section line, N83°26'00"W, a distance of 1108.11 feet; Thence leaving said mid section line North 06°34’ 00” East, perpendicular to said line, 506.00 feet to the TRUE POINT OF BEGINNING;

Thence North 86°20’ 30” West, 40.04 feet; Thence along a curve to the left on a radius of 20.00 feet and a length of 23.79 feet with a chord bearing of North 59°34’ 40” East, and a chord length of 22.42 feet; Thence North 25°29’ 40” East, 239.05 feet; Thence along a curve to the left on a radius of 20.00 feet, and a length of 39.04 feet with a chord bearing of North 30°25’ 30” West, and a chord length of 33.13 feet; Thence North 86°20’ 30” West, 54.95 feet; Thence North 78°37’ 10” East, 198.76 feet; Thence along a curve to the left on a radius of 360.00 feet and a length of 201.52 feet with a chord bearing of South 41°41’ 20” West, and a chord length of 198.90 feet; Thence South 25°39’ 10” West, 169.11 feet to the TRUE POINT OF BEGINNING.

The above tract of land contains 0.26 acres, (11420 sq. ft.), and is a portion of the same land described by Deed Recorded in Book 2645, Page 169 of the Boone County Records.  Subject to easements and restrictions of record or not of record, if any.

is in excess and surplus to the needs of the City and shall be vacated without further action of the City Council upon the completion of the following obligations of Solitude Development, LLC (“Solitude”) pursuant to a development agreement between Solitude and the City:

    a.    Installation of a diagonal diverter at the intersection of Limerick Lane and Hatton Drive;

    b.    Installation of a mountable rollback curb island and a mountable rumble island in the intersection of Hatton Drive, Mills Drive and Shannon Place;

    c.    Removal of the pavement from the portion of Mills Drive that is to be vacated.

    SECTION 2.    The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri after Solitude Development has fulfilled its obligations listed in section 1 of this ordinance.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
