Section 107-646; Ord. 19256; Approving the Final Plat of Rocky Creek Estates Plat 2, a minor subdivision; authorizing a performance contract

approving the Final Plat of Rocky Creek Estates Plat 2, a minor subdivision; accepting
dedication of rightsofway and easements; authorizing a performance contract; granting a variance
from the Subdivision Regulations regarding direct driveway access on Forum Boulevard; and
fixing the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. The City Council hereby
approves the Final Plat of Rocky Creek Estates Plat 2,
dated August 17, 2006, a minor subdivision located on the east side of Forum Boulevard,
approximately 225 feet north of the intersection of Forum Boulevard and Old Plank Road,
containing 0.96 acre in the City of Columbia, Boone County, Missouri, and hereby authorizes
and directs the Mayor and City Clerk to sign the plat evidencing such approval.
SECTION 2. The City Council hereby
accepts the dedication of all rightsofway and
easements as dedicated upon the plat.
SECTION 3. The City Manager is hereby
authorized to execute a performance contract with
Chris Holliday and Stacey Holliday in connection with the approval of the Final Plat of Rocky
Creek Estates Plat 2. The form and content of the contract shall be substantially as set forth
"Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.
SECTION 4. Subdivider is granted a
variance from the requirement of Section 25-53(4) of
the Subdivision Regulations so that Lot 1 shall be allowed direct driveway access on Forum
SECTION 5. This ordinance shall be
in full force and effect from and after its passage.
