    AN ORDINANCE

approving the Final Plat of Copperstone Plat 1, a major subdivision; accepting the dedication of rightsofway and easements; authorizing a performance contract; granting a variance from the Subdivision Regulations regarding sidewalk construction; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council hereby approves the Final Plat of Copperstone Plat 1, dated September 20, 2006, a major subdivision located on the east side of Scott Boulevard, approximately one-half mile south of the intersection of Vawter School Road and Scott Boulevard, containing approximately 64.58 acres in the City of Columbia, Boone County, Missouri, and hereby authorizes and directs the Mayor and City Clerk to sign the plat evidencing such approval.

    SECTION 2.    The City Council hereby accepts the dedication of all rightsofway and easements as dedicated upon the plat.

    SECTION 3.    The City Manager is hereby authorized to execute a performance contract with Woodland Hills Properties LLC in connection with the approval of the Final Plat of Copperstone Plat 1.  The form and content of the contract shall be substantially as set forth in "Exhibit A" attached hereto and made a part hereof as fully as if set forth herein verbatim.

    SECTION 4.    Subdivider is granted a variance from the requirements of Section 25- 48.1 of the Subdivision Regulations so that a sidewalk shall not be required along a 120-foot long portion of the east side of Scott Boulevard crossing Mill Creek, adjacent to the proposed Lots C101 and 142 within Copperstone  Plat 1; provided, that subdivider shall construct an eight-foot pedway through the interior of the site that will connect to a bridge crossing Mill Creek.

    SECTION 5.    This ordinance shall be in full force and effect from and after its passage.
