     AN ORDINANCE

vacating a portion of a drainage easement located within Arbor Falls Plat 1 Subdivision; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council finds and determines that a portion of a drainage easement located within Arbor Falls Plat 1 Subdivision, more particularly described as follows:

A TRACT OF LAND LOCATED IN SECTION 22, TOWNSHIP 48 NORTH, RANGE 12 WEST, CITY OF COLUMBIA, BOONE COUNTY, MISSOURI, BEING PART OF LOT TWO OF OLD HAWTHORNE PLAT 1 AS RECORDED IN PLAT BOOK 40, PAGE 86 OF THE BOONE COUNTY RECORDS; AND MORE PARTICULARLY DESCRIBED AS FOLLOWS;

COMMENCING AT THE NORTHEAST CORNER OF SAID LOT TWO, THENCE ALONG THE NORTH LINE OF SAID LOT, N70°48’ 30"W, 78.37 FEET; THENCE S04°22’ 20”E, 8.05 FEET TO THE POINT OF BEGINNING; THENCE S12°04’ 00”E, 119.50 FEET; THENCE S04°22’ 20”E, 12.10 FEET; THENCE S78°33’ 20”E, 1.77 FEET; THENCE S12°04’ 00”E, 17.45 FEET; THENCE N78°33’ 20”W, 20.82 FEET; THENCE N04°22’ 20”W, 142.63 FEET TO THE POINT OF BEGINNING AND CONTAINING 1420 SQUARE FEET.

is in excess and surplus to the needs of the City and is hereby vacated.

    SECTION 2.    The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
