     AN ORDINANCE

rezoning property located on the south side of Northland Drive, across from Argyle Road from District C-P and District PUD-8 to District PUD-8 and District C-P; repealing all conflicting ordinances or parts of ordinances; approving the PUD/C-P development plan of Bear Creek Prairie; setting forth conditions of approval; approving less stringent screening requirements; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in Section 31, Township 49 North, Range 12 West, Boone County, Missouri; being part of lot 21 of Northland Acres as recorded in Plat Book 04 Page 25 of the records of Boone County, Missouri and being more particularly described as follows:

Commencing at the Northwest corner of Lot 21 of Northland Acres, said point being on the south right-of-way line of Northland Drive; thence S89°10’ 20”E, 14.90 feet to the point of beginning; thence continuing along said line, S89°10’ 20”E, 20.00 feet; thence S00°30’ 45”W, 60.00 feet; thence N44°19’ 35”W, 28.36 feet; thence N00°30’ 45”E, 40.00 feet to the point of beginning and containing 1000 sq. ft. or 0.02 acres.

will be rezoned and become a part of District PUD-8 (Planned Unit Development) with a development density not exceeding 8 dwelling units per acre and taken away from District C-P (Planned Business District).  Hereafter the property may be used for single family detached homes, single family attached town homes, multi-family structures, single family live/work units and single family attached carriage houses.  The statement of intent, marked “Exhibit A,” is attached to and made a part of this ordinance.

    SECTION 2.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

A tract of land located in Section 31, Township 49 North, Range 12 West, Boone County, Missouri; being part of lot 21 of Northland Acres as recorded in Plat Book 4 Page 25 of the records of Boone County, Missouri and being more particularly described as follows:

Commencing at the Northwest corner of Lot 21 of Northland Acres, said point being on the south right-of-way line of Northland Drive; thence along said line S89°10’ 20”E, 34.91 feet; thence S00°30’ 45”W, 160.00 feet to the point of beginning; thence S89°10’ 20”E, 243.95 feet; thence S00°18’ 50”W, 13.56 feet; thence N90°00’ 00”W, 244.00 feet; thence N00°30’ 45”E, 17.09 feet to the point of beginning and containing 3740 sq. ft. or 0.09 acres.

will be rezoned and become a part of District C-P (Planned Business District) and taken away from District PUD-8 (Planned Unit Development).  Hereafter the property may be used for a community hub with coffee house and community market.  The statement of intent, marked “Exhibit B,” is attached to and made a part of this ordinance.

    SECTION 3.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 4.    The City Council hereby approves the Bear Creek Prairie PUD/C-P Development Plan, dated November 6, 2006.  The Director of Planning and Development shall use the design parameters set forth in “Exhibit C,” which is attached to and made a part of this ordinance, as guidance when considering any future revisions to the PUD/C-P Development Plan.

    SECTION 5.    Approval of the PUD/CP Development Plan shall be subject to the following conditions:

1.    Developer shall construct a gravel trail across the City property to the west, extending from the west side of the development along the proposed sanitary sewer easement connecting to the Bear Creek Trail.  The exact location and trail specifications shall be subject to City Parks and Recreation Department approval. This improvement is estimated at approximately 360 lineal feet of eight-foot wide gravel trail at a cost of $15.00 per foot for $5,400.00

2.    Developer shall construct a sidewalk along Northland Drive, to close a sidewalk gap along City-owned property, after the 23 rd building permit (50%) is issued in the first phase of the project.  This improvement is estimated at approximately 275 lineal feet of five-foot sidewalk at a cost of $25.00 per foot for $6,875.00.

3.    Developer shall construct a sidewalk along Northland Drive in the second and third phase of the project after the 23 rd building permit (50%) is issued in the first phase.  This improvement is estimated at approximately 560 lineal feet of five-foot sidewalk at a cost of $25.00 per foot for $14,000.00.

4.    As part of the first phase of the development, developer shall construct a concrete pad for a permanent bus stop and connecting sidewalk from the proposed sidewalk to Northland Drive across the roadside ditch.  This improvement is estimated at approximately 75 square feet at a cost of $15.00 per square foot for a total of $1,125.00.

The improvements described above shall be constructed in lieu of any future tax bills for that portion of Northland Drive adjacent to the subject tract.

    SECTION 6.    The City Council approves less stringent screening requirements than those set forth in Section 29-17(d)(6) of the Zoning Regulations so that a landscape screen shall not be required between the C-P zoned tract and the PUD zoned tract.

    SECTION 7.    This ordinance shall be in full force and effect from and after its passage.
