     AN ORDINANCE

vacating excess street right-of-way along the south side of Blue Ridge Road, west of the Garth Avenue and Blue Ridge Road intersection; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council finds and determines that certain excess street right-of-way along the south side of Blue Ridge Road, west of the Garth Avenue and Blue Ridge Road intersection, more particularly described as follows:

A part of Blue Ridge Road as platted by Hunters Gate Plat 1 as recorded in Plat Book 28 at Page 36 of the Boone County Records; situate in the City of Columbia, Boone County, Missouri; said parcel being described as follows:

Starting at the northeast corner of said Plat 1; thence along the north line of said Plat 1, said north line also being the south line of Vanderveen Crossing, Plat No. 13 as recorded in Plat Book 37 at Page 94 of said Boone County Records, N.85°38’ 30”W., 42.65 feet to the POINT OF BEGINNING on the west line of Blue Ridge Road as platted by said Vanderveen Crossing; thence leaving said north line, along the extension of said Blue Ridge Road as platted by said Vanderveen Crossing, along a non-tangent curve to the right having a radius of145.00 feet a distance of 55.63 feet (the chord of said curve having bearing and distance of S.38°43’ 05”E., 55.29 feet) to the northeasterly line of Lot 37 of said Hunters Gate Plat 1; thence along said line along a non-tangent curve to the left having a radius of 30.00 feet a distance of 21.51 feet (the chord of said curve having bearing and distance of  N.65°06’ 00”W., 21.05 feet); thence along the north line of Lots 37, 36, 35 and 34 N.85°38’ 30”W., 339.57 feet to the west line of said Plat 1; thence along said west line N.4°21’ 30”E., 33.00 feet to the northwest corner of said Plat 1; thence along said north line of said Plat 1 S.85°38’ 30”E., 321.53 feet to the POINT OF BEGINNING.



is in excess and surplus to the needs of the City and is hereby vacated.

The underlying easement for ingress, egress and utility purposes as shown by a survey recorded in Book 494 at Page 470 is not part of this vacation.

    SECTION 2.    The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
