     AN ORDINANCE

rezoning property located on the northwest corner of Oakland Gravel Road and Vandiver Drive from District R-1 to District PUD-7; repealing all conflicting ordinances or parts of ordinances; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The Zoning District Map established and adopted by Section 294 of the Code of Ordinances of the City of Columbia, Missouri, is amended so that the following property:

An irregular shaped parcel of land in part of a tract of land described in a warranty deed in Book 424 at Page 306 of the Boone County Records; situate in the east half (1/2) of the southeast quarter (1/4) of the northeast quarter (1/4) of Section 6, Township 48 North, Range 12 West, in the City of Columbia, Boone County, Missouri; said parcel being described as follows:

BEGINNING at the northeast corner of Lot 18 of Powell Subdivision as recorded in Plat Book 6 at Page 40 of said Boone County Records, said corner being on the south right-of-way line of Powell Drive; thence along said right-of-way line and the south line of Lots 3 and 6 of said subdivision S.89°23’ 35”E., 393.54 feet to the westerly right-of-way line of Oakland Gravel Road; thence leaving said south lines and along said westerly right-of-way line along a non-tangent curve to the right having a radius of 285.31 feet a distance of 212.31 feet (the chord of said curve having bearing and distance of S.39°16’ 40”W., 207.45 feet); thence along a curve to the left having a radius of 351.31 feet a distance of 302.34 feet (the chord of said curve having bearing and distance of  S.33°33’ 45”W., 293.10 feet); thence along a curve to the right having a radius of 30.00 feet a distance of 40.27 feet (the chord of said curve having bearing and distance of  S.47°21’ 50”W., 37.32 feet) to the northerly right-of-way line of Vandiver Drive; thence along said northerly line along a curve to the left having a radius of 512.47 feet a distance of 205.54 feet (the chord of said curve having bearing and distance of S.74°19’ 50”W., 204.16 feet); thence leaving said northerly line N°53°50’ 00”W., 108.19 feet to the south line of said Powell Subdivision; thence along said south line S.89°23’ 35”E., 212.35 feet to the southeast corner of Lot 21 of said Powell Subdivision; thence along the east line of Lots 21, 20, 19 and 18 N.0°09’ 00”W., 427.80 feet to the POINT OF BEGINNING and containing 2.38 acres.

will be rezoned and become a part of District PUD-7 (Planned Unit Development) with a development density not exceeding seven dwelling units per acre and taken away from District R-1 (One-Family Dwelling District).  Hereafter the property may be used for multi-family dwellings consistent with a Request for Proposals developed by the City Council dated February 3, 2009.  The statement of intent submitted by applicant, marked “Exhibit A” is attached to and made a part of this ordinance.

    SECTION 2.    All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
