Section 110-231; Res. 101-09; Declaring the necessity for construction of sanitary sewers in Sewer District No. 166 (Thompson Road); fixing the time for a public hearing thereon

     A RESOLUTION

declaring the necessity for construction of sanitary sewers in Sewer District No. 166 (Thompson Road); stating the nature of and the estimate of the cost thereof; providing for payment for the improvement; providing for compliance with the prevailing wage law; and fixing the time for a public hearing thereon.

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council deems the construction of sanitary sewers, wye branches, manholes and other necessary appurtenances in Sewer District No. 166 necessary to the welfare and improvement of the City.

    SECTION 2.    The nature and scope of the improvement shall consist of furnishing all labor, materials, transportation, insurance and all other items, accessories and incidentals thereto necessary for the complete construction of the improvements.

    SECTION 3.    The estimated cost of this improvement is $69,000.00.

    SECTION 4.    Payment for this improvement shall be made by special tax bills evidencing special assessments levied and assessed against the lots, tracts or parcels of ground specially benefited in Sewer District No. 166 of the City, in proportion to the area of the whole district exclusive of public highways, in the manner specified by the laws of the State of Missouri and the Charter and Ordinances of the City of Columbia, in a unit rate not to exceed $0.485 per square foot; and the balance from Sanitary Sewer Utility Funds and such other funds as may be lawfully appropriated or lawfully used for such purpose, the boundaries of Sewer District No. 166 being described as follows:

Three parcels of land in the west half (1/2) of the northwest quarter (1/4) of the northeast quarter (1/4) of Section 34, Township 49 North, Range 12 West; situate in the City of Columbia (one parcel has not been annexed), Boone County, Missouri; said parcels being described as follows:

BEGINNING on the centerline of a road at the southwest corner of Tract 2 of a Survey as recorded in Book 392 at Page 581 of the Boone County Records; thence along the west line of said tract N.0°00’ E., 438.3 feet to the northwest corner of said tract and the southwest corner of Tract 1 of said survey; thence along the south line of said Tract 1 N.90°00’ E., 264.1 feet; thence continuing along the lines of said Tract 1 S.0°00’ E., 97.2 feet; N.64°30’ E., 224.4 feet to the southeast corner of said Tract 1; thence along the extension of the east line of said Tract 1 S.0°00’ E., 215.1 feet to the centerline of said road at the southeast corner of a tract of land described in a warranty deed in Book 2581 at Page 143 of said Boone County Records and on the extension of the south line of said Tract 2; thence along the lines of said deed and said extension S.64°30’ W., 517.0 feet to the POINT OF BEGINNING.

The above described Sewer District contains 3.28 acres.

    SECTION 5.    Any work done in connection with the construction of the improvement specified above shall be in compliance with the provisions of the prevailing wage laws of the Department of Labor and the State of Missouri, such prevailing wage rates having been established by the Industrial Commission of Missouri.

    SECTION 6.    A public hearing in respect to this improvement will be held in the Council Chamber of the Daniel Boone Building, 701 E. Broadway, Columbia, Missouri, at 7:00 p.m. on July 6, 2009.  The City Clerk shall cause notice of this hearing to be published in a newspaper published in the City.
