extending the corporate limits of the City of Columbia, Missouri, by annexing property
on the east side of Rolling Hills Road, extended, approximately one mile north of State Route
WW; directing the City Clerk to give notice of the annexation; placing the property annexed in
District R-1; and fixing the time when this ordinance shall become effective.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS
SECTION 1. The City Council hereby
finds that a verified petition was filed with the City
on December 18, 2008, requesting the annexation of land which is contiguous and compact to the
existing corporate limits of the City and which is described in Section 4 of this ordinance. This
petition was signed by William D. Powell, manager of Heartland Wood, LLC and William D.
and Neva C. Powell, the owners of the fee interest of record in the land proposed to be annexed.
A public hearing was held concerning this matter on January 20, 2009. Notice of this hearing
was published more than seven days prior to the hearing in two newspapers of general circulation
qualified to publish legal matters. At the public hearing all interested persons, corporations
political subdivisions were permitted to present evidence regarding the proposed annexation.
SECTION 2. The Council determines
that the annexation is reasonable and necessary to the
proper development of the City and that the City has the ability to furnish normal municipal
services to the area to be annexed within a reasonable time.
SECTION 3. The Council determines
that no written objection to the proposed annexation
has been filed within fourteen days after the public hearing.
SECTION 4. The City Council hereby extends the city limits
by annexing the land described in
Section 1-11.200 of the Code of Ordinances of the City of Columbia, Missouri, which is hereby
added to Chapter 1 of the City Code and which reads as follows:
Section 1-11.200. February, 2009 Extension of Corporate Limits.
The corporate limits of the City of Columbia shall include the following land:
A TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 15,
TOWNSHIP 48 NORTH, RANGE 12 WEST, BOONE COUNTY, MISSOURI AND BEING
THE TRACT OF LAND DESCRIBED BY THE WARRANTY DEEDS RECORDED IN BOOK
2768, PAGE 13 AND BOOK 2767, PAGE 196 AND THE QUIT-CLAIM DEEDS RECORDED
IN BOOK 3150, PAGES 21 AND 22 AND BEING PART OF TRACT F OF THE SURVEY
RECORDED IN BOOK 1611, PAGE 799 AND BEING MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
BEGINNING AT THE CENTER OF SECTION 15 AS SHOWN ON THE SURVEY
RECORDED IN BOOK 1611, PAGE 799; THENCE FROM THE POINT OF BEGINNING
AND WITH THE WEST LINE THEREOF, N 0º45 15E, 609.68 FEET; THENCE N 39º43
15E, 742.17 FEET TO THE SOUTH LINE OF THE TRACT DESCRIBED BY THE
WARRANTY DEED RECORDED IN BOOK 2547, PAGE 148; THENCE LEAVING THE
WEST LINE OF SAID SURVEY AND WITH SAID SOUTH LINE AND SAID SOUTH LINE
EXTENDED, S 60º16 45E, 359.98 FEET TO THE SOUTHERN MOST CORNER OF
TRACT E OF SAID SURVEY RECORDED IN BOOK 1611, PAGE 799; THENCE
CONTINUING WITH THE LINES OF SAID SURVEY, N 69º43 15E, 390.00 FEET;
THENCE S 80º16 45E 350.00 FEET; THENCE N 4º43 15E, 130.00 FEET; THENCE
69º52 00E, 212.45 FEET; THENCE S 74º29 30 E, 319.64 FEET TO THE WEST
TRACT F-1 OF THE SURVEY RECORDED IN BOOK 1642, PAGE 326; THENCE WITH
THE WEST LINE OF SAID TRACT F-1, S 36º17 05 W, 396.83 FEET; THENCE S 1º19
55E, 846.93 FEET TO THE NORTH LINE OF THE SURVEY RECORDED IN BOOK 2591,
PAGE 24; THENCE LEAVING THE LINES OF TRACT F-1 AND WITH THE NORTH LINE
OF SAID SURVEY RECORDED IN BOOK 2591, PAGE 24, S 89º05 25 W, 1808.95 FEET
TO THE POINT OF BEGINNING AND CONTAINING 44.15 ACRES.
SECTION 5. The City Clerk is hereby
authorized and directed to cause three certified copies
of this ordinance to be filed with the Clerk of Boone County, Missouri and three certified copies
with the Assessor of Boone County, Missouri. The City Clerk is further authorized and directed
to forward to the Missouri Department of Revenue, by registered or certified mail, a certified
copy of this ordinance and a map of the City clearly showing the area annexed to the City.
SECTION 6. The property described
in Section 4 is in the Sixth Ward.
SECTION 7. The Zoning District Map
established and adopted by Section 294 of the Code
of Ordinances of the City of Columbia, Missouri, is hereby amended so that the property
described in Section 4 will be zoned and become a part of District R-1 (One-Family Dwelling
SECTION 8. This ordinance shall be
in full force and effect from and after its passage.
