Section 110-467; Res. 204-09; Declaring the necessity for construction of the East Side Sidewalk Reconstruction Project, Phases 1 and 2; setting a public hearing

     A RESOLUTION

declaring the necessity for construction of the East Side Sidewalk Reconstruction Project, Phases 1 and 2, to include the reconstruction of sidewalks along portions of the north and south sides of Walnut Street, the north side of Paquin Street, the north side of Anthony Street and both sides of Broadway and College Avenue; stating the nature of and the estimate of the cost of the improvement; providing for payment for the improvement; providing for compliance with the prevailing wage law; and setting a public hearing.

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council deems the construction of the East Side Sidewalk Reconstruction Project, Phases 1 and 2, necessary to the welfare and improvement of the City. Phase 1 shall be for sidewalks along the north side of Walnut Street from Hubbell Drive to William Street, the south side of Walnut Street from Short Street to Ripley Street, the north side of Paquin Street from Hitt Street to College Avenue and the north side of Anthony Street from College Avenue to William Street; and Phase 2 shall be for sidewalks along both sides of East Broadway from Short Street to William Street and both sides of College Avenue from Paquin Street to Windsor Street.

    SECTION 2.    The nature and scope of the improvement shall consist of furnishing all labor, materials, transportation, insurance and all other items, accessories and incidentals thereto necessary for the complete construction of the improvements.

    SECTION 3.    The estimated cost of Phase 1 of this improvement is $195,339.00 and the estimated cost of Phase 2 of this improvement is $268,547.00.

    SECTION 4.    Payment for Phase 1 of this improvement shall be made from Federal American Recovery and Reinvestment Act of 2009 funding and such other funds as may be lawfully appropriated; payment for Phase 2 of this improvement shall be made from Community Development Block Grant Funds and such other funds as may be lawfully appropriated.

    SECTION 5.    Any work done in connection with the construction of the improvement specified above shall be in compliance with the provisions of the prevailing wage laws of the State of Missouri.

    SECTION 6.    The City shall also cause to be inserted into the contract a stipulation that all laborers and mechanics employed by the contractor or subcontractors in the performance of work under the contract shall be paid wages at rates not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with the Davis-Bacon Act.

    SECTION 7.    A public hearing in respect to this improvement will be held in the Council Chamber of the Daniel Boone Building, 701 E. Broadway, Columbia, Missouri, at 7:00 p.m. on September 21, 2009.  The City Clerk shall cause notice of this hearing to be published in a newspaper published in the City.
