     AN ORDINANCE

vacating a sewer easement located on Lot 10 within Hathman Subdivision; directing the City Clerk to have a copy of this ordinance recorded; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    The City Council finds and determines that a certain sewer easement located on Lot 10 within Hathman Subdivision, more particularly described as follows:

A TRACT OF LAND LOCATED IN THE SOUTHEAST QUARTER OF SECTION 6, TOWNSHIP 48 NORTH, RANGE 12 WEST, CITY OF COLUMBIA, BOONE COUNTY, MISSOURI AND BEING A PORTION OF LOT 10 OF HATHMAN SUBDIVISION AS RECORDED IN PLAT BOOK 10, PAGE 87 OF THE BOONE COUNTY RECORDS AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

COMMENCING AT THE NORTHWEST CORNER OF LOT 10 OF SAID PLAT; THENCE ALONG THE WEST LINE OF SAID LOT, S09°12’ 25”W, 32.70 FEET TO THE POINT OF BEGINNING; THENCE LEAVING SAID LINE, S52°53’ 50”E, 169.79 FEET TO THE EAST LINE OF SAID LOT; THENCE ALONG SAID LINE, S09°13’ 05”W, 22.63 FEET; THENCE LEAVING SAID LINE, N52°53’ 50”W, 169.78 FEET TO THE WEST LINE OF SAID LOT 10; THENCE ALONG SAID LINE, N09°12’ 55”E, 22.63 FEET TO THE POINT OF BEGINNING AND CONTAINING 3,395 SQUARE FEET.

Except those portions of this tract that are described in the grant of easement for sewer purposes by New Horizons Community Support Services Inc. to the City of Columbia dated July 9, 2009 and recorded at Book 3553 Page 59 of the Boone County, Missouri records.

is in excess and surplus to the needs of the City and is hereby vacated.

    SECTION 2.    The City Clerk is hereby authorized and directed to cause a copy of this ordinance to be recorded in the office of the Recorder of Deeds of Boone County, Missouri.

    SECTION 3.    This ordinance shall be in full force and effect from and after its passage.
