     AN ORDINANCE

providing for the recovery of costs associated with the formation of community improvement districts; and fixing the time when this ordinance shall become effective.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBIA, MISSOURI, AS FOLLOWS:

    SECTION 1.    It is a policy of the City of Columbia to recover costs to the City associated with the processing of petitions to establish community improvement districts.  

    SECTION 2.    Petitions for the establishment of community improvement districts must be accompanied by deposits sufficient to pay the cost of all required advertising and mailings.  If the amount of the deposit is less than the actual costs, the petitioner shall pay the difference to the City.  If the amount of the deposit exceeds the actual costs, the City shall pay the difference to the petitioner.

    SECTION 3.    Unless the City Council waives this requirement, the petitioner petitioning for the establishment of a community improvement district must agree to pay all City staff and any City consultant and special counsel costs for review and analysis of the community improvement district petition.  The City will provide petitioner with an estimate of such cost within two weeks after the petition is filed.  The petitioner must deposit the amount of the estimate with the City Clerk no later than one (1) week after the City has provided the estimate.  If it appears that the actual costs will exceed the amount of the initial deposit, the City may require additional deposits.  If the total amount deposited is less than the actual costs, the petitioner shall pay the difference to the City. If the total amount deposited exceeds the actual costs, the City shall pay the difference to the petitioner.

    SECTION 4.     This ordinance shall be in full force and effect from and after its passage.
