Smoking Ordinance FAQ

The Columbia Smoking Ordinance was developed to protect the public from exposure to and the discomfort from second hand smoke.  The ordinance prohibits smoking in commercial establishments with some exemptions.

Where is smoking prohibited?

  • The following establishments prohibit smoking: retail stores, banks, office buildings, offices, restaurants, bars, public transportation vehicles, restrooms, libraries, educational facilities, day care facilities, museums, auditoriums, art galleries, indoor public area of health care facilities, any indoor place of entertainment or recreation, all public areas and waiting rooms of public transportation facilities, enclosed areas serving as a place of work or used by the public, rooms where meetings or public hearings are held, any City owned building, seating areas of enclosed spaces (stadium, outdoor arena, athletic field).
  • Hotels and motels must designate non smoking rooms.
  • A recent revision to the ordinance prohibits anyone from smoking within twenty (20) feet of an entrance to any structure in which smoking is prohibited or limited by Article IX.

Are there exemptions?

  • Some places are exempt from having a nonsmoking area. These include an entire room or hall used for private social functions provided the room/hall has a separate ventilation system to the outside, a private enclosed office with a ventilation system not shared with non smoking offices and is occupied exclusively by smokers, performers on stage as part of a theatrical performance, patio areas of any restaurant, bar or other commercial establishment provided no more than fifty percent (50%) of the patio be designated for smoking and non smokers do not have to pass through smoking sections to obtain access to non smoking sections.

Are private clubs exempt?

  • Private clubs are exempt provided they meet the following criteria: 
  • The membership association is a private, non-for profit organization formed before April 1, 2006, the association is organized primarily for the benefit of its members, the association members pay dues, the association is managed, operated by a board consisting entirely of its own members, the association is organized primarily as a recreational, fraternal, athletic, military veteran, religious or kindred association, the association does not primarily serve food or alcoholic beverages, all operational duties are performed by uncompensated members, the general public is not invited.

What is the responsibility of the proprietor?

  • The proprietor or person in control of the area not exempt from smoking must post "No Smoking" signs or a sign with the international "No Smoking" symbol. Upon observation of an individual smoking, the proprietor or person in control shall request that person stop smoking.

What happens if the person does not quit smoking?

  • They can be fined no more than $200.

Who enforces the smoking ordinance?

  • The smoking ordinance is enforced by the Health Department.

Who can I call to make a smoking complaint?

  • The Environmental Health section of the Health Department fields smoking complaints and has a 24 hour hotline for complaints after hours: (573)874-7339.

The Sale of Tobacco to Minors:

  • it is illegal for tobacco products or paraphernalia to be sold to any person under the age of eighteen
  • any business that sells such products must have a warning sign at each display where the products are sold 
  • vending machines must also have a warning sign and be placed in an area that is inaccessible to minors
  • violations and fines for the sale of tobacco products and paraphernalia can range from $100 to $500
