Prior to the adoption of 17135 on 04/08/2002, Section 11-65 read as follows.


    (a) Except as provided in section 11-66 it shall be unlawful for:

    (1)    Any retailer doing business within the city limits to refuse, during such retailer's normal business hours, to accept from any person any clean empty beverage container of the kind, size and brand sold by the retailer and labeled as provided in section 11-64(b), or to refuse to pay to that person the refund value of that container as established by section 11-64.

    (2)    Any distributor doing business within the city limits to refuse to accept from a retailer any empty beverage container of the kind, size and brand sold by the distributor or to refuse to pay the retailer the refund value of a beverage container as established by section 11-64.

    (b) Violation of this section shall be punishable as a misdemeanor as further provided in section 11-68.
