Prior to the adoption of Ord. 21752 on 07/15/2013, Section 27-119 read as follows.

    (a)    Availability.  Upon application and by approval of the director, the data transfer and communication equipment structure rate is available for limited electrical service to data transfer and communication equipment.  To qualify for this rate, the customer shall have at least one (1) metered data transfer and communication equipment shelter of similar size containing similar data transfer and communications equipment and the customer shall agree to allow the director or the director’s designee access to the equipment, shelter, and records related to the equipment and shelter  for purposes of audits and inspections.  The director shall only approve the application of this rate to a customer’s data transfer and communication equipment structure when the director, in the director’s sole discretion, determines:

1.    The electrical service is to be used by data transfer and communication equipment housed within an exterior structure that is no greater than twenty-four (24) cubic feet in size;

2.    Based upon metered data of a similarly sized structure with the similar data transfer and communications equipment, the estimated daily electrical usage for each piece of equipment contained within the exterior structure is less than three (3) kWh;  

3.    That it is a benefit to the utility not to install a meter for the service; and

4.    That the service shall not include lighting of the exterior structure or premises.  

    (b)    Type of service.  The type of service shall be single-or three-phase, sixty-hertz, at one of the department's standard service voltages.

    (c)    Calculation of estimated usage.  For each exterior structure containing data transfer and communications equipment, the director or the director’s designee shall estimate usage based upon metered usage of similar equipment.

    (d)    Monthly rate charge.  The monthly rate per kilowatt hour shall be as follows, subject to fuel adjustment as provided in section 27-118:

    Customer charge    $10.85 per month
    Cost per kWh    9.44 cents per kWh

    (e)    Minimum monthly bill. The minimum bill for single- or three-phase service shall be ten dollars and eighty-five cents ($10.85) per month.    

    (f)    Payment in lieu of taxes and sales tax. In addition to the charge based on monthly rates as computed above, the total monthly charge for service shall include applicable sales taxes and the current in lieu of gross receipts tax payment. Sales taxes shall be applied to the total of the monthly rate charge and the in lieu of gross receipts tax payment.
